Exclusive: LA Phil is sued by unpaid employees

A class action has been filed in Los Angeles on behalf of Diane Alvarez and others who are claiming for unpaid wages. They also claim violations of the California Labor Code including failing to provide meal breaks, failing to maintain accurate payroll records, failing to provide accurate wage statements.

The lawyers have appealed to anyone employed in July 2021 to join the class action.

Meanwhile, a provisional settlement has been agreed. Here’s what the Notice of Class Action specifies:


WHAT ARE THE IMPORTANT TERMS OF THE PROPOSED SETTLEMENT?
The Gross Settlement Amount is $970,000.00 (“Gross Settlement Amount”). The LA Phil has agreed to deposit $970,000.00 into an account controlled by the Settlement Administrator for the Settlement (the “Gross Settlement Amount”). The Settlement Administrator will use the Gross Settlement Amount to pay the Individual Class Payments to Participating Class Members, Individual PAGA Payments to Aggrieved Employees, Enhancement Award to Plaintiff, Attorneys’ Fees and Costs to Class Counsel, the Settlement Administration Costs to the Settlement Administrator, and LWDA Payment to the LWDA. Assuming the Court grants final approval of the Settlement, the LA Phil will fund the Gross Settlement Amount plus the employer portion of the payroll taxes due on wage payments made from the Net Settlement Amount to Class Members not more than 30 calendar days after the Effective Date of the Settlement. The Settlement Administrator will make the required payments within seven calendar days after the LA Phil deposits the Gross Settlement Amount and Employer Taxes.
